Proposed MRAP Ordinance Submitted to Michigan City Council

AN ORDINANCE TO INSTRUCT THE MICHIGAN CITY POLICE DEPARTMENT TO RETURN OR TRANSFER THE MILITARY RESISTANT AMBUSH VEHICLE (MRAP) VEHICLE

WHEREAS, the Citizens of Michigan City do not desire the use of a Military Resistant Ambush Protected (MRAP) vehicle on its streets or in our neighborhoods,

WHEREAS, the Citizens of Michigan City view that all costs, time and funds required for maintenance, retrofitting, training, and ongoing operation of the military MRAP would be better allocated and utilized for other law enforcement and community needs,

WHEREAS, the design, weight and purpose of the military MRAP makes the vehicle unsuitable for use on unimproved streets, bridges and land and as such, poses a risk to life, private land, private property, public lands and public property,

WHEREAS, the People of Michigan City were not consulted in the decision to acquire the military MRAP from the Department of Defense,

NOW, THEREFORE, BE IT ORDAINED by the Common Council of the City of Michigan City, LaPorte County, Indiana as follows:

That the Michigan City Police Department is instructed to give termination notice, within 14 days, under the terms of the MRAP agreement contract and take action to either; return the MRAP vehicle to the Department of Defense or to transfer the MRAP vehicle to the Indiana National Guard, in accordance to the terms of the Law Enforcement Support Office (LESO) 1033 program and contract agreement.

That all future requests for new or surplus military equipment, of a style, model or type not already in use by the Michigan City Police Department, will require public notification, publication and an open public hearing prior to making such requests and decisions.
